WITH REFERENCE TO REF (B) TURKISH NOTAM A0099/26 WE POINT OUT THAT
THE ASSERTIONS CONTAINED THEREIN ARE REJECTED AS MISLEADING AND
DEVOID OF ANY LEGAL BASIS. IN THIS RESPECT AND FURTHER TO THE REF
(A) GREEK NOTAM  A0619/26, PARA 2.2, WE REITERATE THAT GREECE,
ESTABLISHED IN 1931 IN ACCORDANCE WITH INTERNATIONAL LAW A
TERRITORIAL SEA OF TEN NAUTICAL MILES FOR THE PURPOSES OF AVIATION
AND THE CONTROL THEREOF.
THEREFORE, GREEK AIRSPACE DOES NOT EXCEED THE BREADTH OF THE
TERRITORIAL SEA AS ESTABLISHED IN 1931.
GREECE, THEREFORE,  FULLY ABIDES BY INTERNATIONAL LAW AND WILL
CONTINUE TO DO SO WHILE FULLY EXERCISING ITS SOVEREIGNTY. IN FACT, AS
FAR AS INTERNATIONAL LAW IS CONCERNED, TURKEY IS THE ONLY COUNTRY,
REGRETTABLY, WHICH ALSO FAILS TO RESPECT THE PROVISIONS OF THE
CHICAGO CONVENTION WITHIN THE ATHINAI FIR, WHERE, IN ACCORDANCE WITH
THE ICAO REGIONAL AIR NAVIGATION AGREEMENTS OF 1950-1952-1958, THE
END PART 1 OF 3
GREEK AUTHORITIES ARE THE ONLY COMPETENT AUTHORITIES CHARGED TO
IMPLEMENT THE RELEVANT PROVISIONS OF THE CHICAGO CONVENTION AND TO
ENSURE UNIMPEDED, REGULAR AND SAFE AIR TRAFFIC.
ALSO, REFERENCE IS MADE TO THE ABOVE REF (B) TURKISH NOTAM A0924/26
IN ORDER TO STATE THAT THE ATHINAI/ISTANBUL FIR BOUNDARY BETWEEN
POINTS 404500N0261000E AND 360500N0300000E HAS BEEN ESTABLISHED BY
ICAO REGIONAL AGREEMENTS (REACHED IN THE SECOND MIDDLE EAST REGIONAL
AIR NAVIGATION MEETING, ISTANBUL 1950 AND SUBSEQUENTLY APPROVED  BY
THE ICAO COUNCIL ON 14 DEC 1950, DOC 7055 MID/2-RAC) WITH THE
PARTICIPATION AND APPROVAL OF TURKEY AND IN FEB 1958, (DOC 7870,
EUM/IV) AND CONSEQUENTLY IS FOUNDED ON THE FIRMEST POSSIBLE LEGAL
BASIS AS NOTED IN OUR A1709/07 LGGGYNYX NOTAM.
FURTHERMORE THE SAID ATHINAI/ISTANBUL FIR BOUNDARY WAS DEPICTED ON
CHART NUMBER 7 ATTACHED TO THE REGIONAL AIR NAVIGATION AGREEMENT
WHICH WAS REACHED IN THE THIRD REGIONAL AIR NAVIGATIONAL CONFERENCE
(PARIS 1952) AND SUBSEQUENTLY APPROVED BY THE ICAO COUNCIL ON 23
JUNE 1952. ACCORDINGLY, GREECE HAS BEEN ASIGNED RESPONSIBILITY FOR
ALL ATM
SERVICES AND ICAO PURPOSES AS WELL AS FOR SAR  WITHIN
ATHINAI FIR/ HELLAS UIR AND IS THE ONLY COMPETENT THEREIN.
