REF (C) TURKISH NOTAM A2193/26 (211331 EUECYIYN MAY 2026). REFERENCE IS MADE TO THE ABOVE REF (B) TURKISH NOTAM A2333/26 LTAAYNYX IN ORDER TO STATE THAT THE ATHINAI/ISTANBUL FIR BOUNDARY BETWEEN POINTS 404500N0261000E AND 360500N0300000E HAS BEEN ESTABLISHED BY ICAO REGIONAL AGREEMENTS (REACHED IN THE SECOND MIDDLE EAST REGIONAL AIR NAVIGATION MEETING, ISTANBUL 1950 AND SUBSEQUENTLY APPROVED BY THE ICAO COUNCIL ON 14 DEC 1950, DOC 7055 MID/2-RAC) WITH THE PARTICIPATION AND APPROVAL OF TURKEY AND IN FEB 1958, (DOC 7870, EUM/IV) AND CONSEQUENTLY IS FOUNDED ON THE FIRMEST POSSIBLE LEGAL BASIS AS NOTED IN OUR A1709/07 LGGGYNYX NOTAM. FURTHERMORE THE SAID ATHINAI/ISTANBUL FIR BOUNDARY WAS DEPICTED ON CHART NUMBER 7 ATTACHED TO THE REGIONAL AIR NAVIGATION AGREEMENT WHICH WAS REACHED IN THE THIRD REGIONAL AIR NAVIGATIONAL CONFERENCE (PARIS 1952) AND SUBSEQUENTLY APPROVED BY THE ICAO COUNCIL ON 23 JUNE 1952. ACCORDINGLY, GREECE HAS BEEN ASSIGNED RESPONSIBILITY FOR ALL ATM SERVICES AND ICAO PURPOSES AS WELL AS FOR SAR WITHIN ATHINAI FIR/ HELLAS UIR AND IS THE ONLY COMPETENT THEREIN. THEREFORE, THE DEFINITION OF EXERCISE OR SAR AREAS WITH REFERENCE TO THE AFOREMENTIONED ATHINAI/ISTANBUL FIR BOUNDARY, AS THIS BOUNDARY IS CLEARLY DEPICTED IN THE ICAO AERONAUTICAL CHARTS, IS A JUSTIFIED AND RIGHTFUL PRACTICE NOT LEAVING SPACE FOR MISLEADING OR MISINTERPRETATIONS. ON THE AFOREMENTIONED BASIS THE REF (A) GREEK NOTAM A1827/26 (021132 EUECYIYN JUN 2026), STATED THAT WITH REFERENCE TO REF (C) TURKISH NOTAM A2193/26 (211331 EUECYIYN MAY 2026) A PART OF THE AREA AS DESCRIBED IN REF (A) GREEK NOTAM A1827/26, STRICTLY LIES WITHIN ATHINAI FIR OVERLAPS PART OF RODOS TMA AND GREEK NATIONAL AIRSPACE, WHERE THE ONLY COMPETENT AUTHORITY TO PROMULGATE NOTAMS ACCORDING TO ICAO RULES AND REGULATIONS IS THE HELLENIC AVIATION SERVICE PROVIDER (HASP). CONSEQUENTLY, THE REF (B) TURKISH NOTAM A2333/26 (021211 EUECYIYN JUN 2026) HAS NO GROUND, CANNOT PRODUCE ANY INTERNATIONALLY LEGAL EFFECT WITHIN ATHINAI FIR / HELLAS UIR AND IS CONSIDERED NULL AND VOID.
